Apple was fighting lawsuits for patent infringement on the smartwatch side. US medical device manufacturer Masimo says Apple has been violating its patents since Watch Series 6. Masimo, who took this to court, had been accusing Apple of violating different patents since 2020.
DATE GIVEN
The reason behind this decision that Apple was forced to make is the lawsuit regarding the patent of a software used by the company. In the case heard in the USA, Apple was deemed unfair for being able to detect the oxygen level in the blood using patents belonging to medical equipment manufacturer Masimo.
It has been recorded that Apple violated Masimo’s patents and thus Apple Watch Series 9 and Apple Watch Ultra 2 detect the oxygen level in the blood. The court demanded that Apple stop selling these watches on online platforms as of December 21 and in retail stores as of December 24.
While this decision puts Apple in a corner at a time when sales will increase, such as New Year’s Eve, the only smartwatch model that Apple will launch in the USA will be the brand’s price/performance product, the SE model.
MODELS THAT WILL BE DISCONTINUED FROM SALES ARE ANNOUNCED
Apple, one of the leading technology and software companies in the USA, has decided to stop sales of the smart watch series Apple Watch Series 9 and Apple Watch Ultra 2, which went on sale recently.
EYES ON BIDEN
Financial Times, one of the world’s leading economic and financial newspapers, reported that Apple may veto this decision of US President Joe Biden from the court. The newspaper reminded that former US president Barack Obama decided in favor of Apple in a case in 2013.
In the statement, it was stated that this sales ban will not cover other countries. If Apple does not get the response it expects from Biden, the company will have to change the software and remove the blood oxygen measurement system in order to continue sales.
After the court decision, Apple’s share value decreased by 1 percent, while Masimo’s share value increased by 3.2 percent. Masimo officials also made a statement on the subject. “This decision showed that even the most powerful company in the world must comply with the law,” the statement said.
Bloomberg, one of the leading media organizations in the USA, stated that an agreement between Apple and Masimo is also possible, but pointed out that neither company has taken a step in this direction yet.
