(Finance) – In view of Council chamber set for Monday 13 January before the Lazio Regional Administrative CourtCodacons reiterates its support for the NCC operators (Rental with Driver) in the legal battle against Interministerial Decree no. 226 of 16 October 2024, deemed discriminatory and harmful to interests not only of the category, but above all of users and consumers, which introduces disproportionate restrictions by imposing excessive administrative obligations and violating the principles of free competition enshrined in the Constitution and community legislation. These restrictions, including time limitations for reservations and return-to-rental obligations, they risk favoring only taxis, directly penalizing users, through a reduction in the non-scheduled public transport service.
“We cannot tolerate rules which, disguised as control needs, directly harm consumers – states the president Carlo Rienzi – The limitations imposed not only do they hinder freedom of enterprisebut they increase costs and reduce supply, leaving citizens without adequate and accessible alternatives in non-scheduled public transport”.
Special concern is also raised on the privacy front: the provisions of the decree authorize indiscriminate access to customer data by local authorities, in violation of the GDPR and constitutional protections on the processing of personal data.
Codacons therefore asks the Government and the Ministry of Infrastructure and Transport to review the legislation, eliminating every element of discrimination and favoring a balanced approach that protects users’ rights first and foremost.
