A Chatham woman involved in a 2021 stabbing will learn her fate later this month.
But whether or not Brandy Redmond will receive any extra credit for time served in pre-trial custody will depend on if her lawyer can file the application in time.
Redmond, 29, who recently agreed to a plea arrangement that reduced her original attempted murder charge to a lesser count of aggravated assault, made a brief virtual appearance in a Chatham courtroom Thursday.
During a June 1 court appearance, dates for a Gardiner hearing – a process used to settle disagreements about the facts of the case – was set for July 19. A sentencing hearing was also set for July 21, which depended on whether a pre-sentence report was prepared in time.
Redmond’s lawyer, Daniel Kirby, informed the court the pre-sentence report had been received Wednesday. The dates for the Gardiner and sentencing hearings were confirmed during Thursday’s proceedings.
Kirby previously stated his intention to make an application for enhanced credit for Redmond, who has been in custody at the South West Detention Center in Windsor for more than a year after previously waiving her right to apply for bail.
During the June 1, court appearance, Justice Robert Horton had imposed a deadline of July 7 at 4 pm to receive the materials for the application for enhanced credit.
When asked Thursday if he could meet that deadline, Kirby said he was “going to make every effort.”
Horton indicated the materials will need to be received by the deadline or the application will not proceed.
There is still a publication ban on any evidence heard.
According to previously published reports, Chatham-Kent police officers responded to an April 26, 2021, disturbance outside an apartment building on Riverview Drive in Chatham.
