Brokers lied during bidding – be warned

It was during a bidding for a condominium that a bidder received a text message from the broker. There it appeared that another bidder placed a bid just above the starting price. The complainant then bought the apartment at a slightly more expensive price.

When the complainant then contacted the other bidder, it emerged that she had never placed the bid. However, she had told the broker that she was still interested.

The broker admitted to FMI that there was never an open bid but that the price the bidding landed at was just above the limit of what the seller could accept.

A dissenting panel that assessed the matter says no to the complainant’s demand for damages of SEK 100,000. However, the board agreed to warn the broker, who is considered to have breached his duty of care.
