Boy in Luleå acquitted of rape – the police are criticized

It was in January that the boy and his parents went to the police in Luleå to report a young girl for rape. The day before, the boy had told his parents that he had been forced to have sex with the girl and that she had threatened to kill herself if he did not agree.

But instead the charges were turned against him, and the boy himself was reported against his denial for child rape.

“A couple of serious inaccuracies”

In May, the verdict came from the Luleå district court, which Dagens Juridik has had access to. The boy was acquitted of the charges and the court held that the police’s preliminary investigation contained “a couple of serious inaccuracies”.

Among other things, the court points out that the report that was the basis for the preliminary investigation stated that the boy and his parents went to the police station and reported himself for child rape, when instead it was the girl he reported.

In addition, screenshots of a chat conversation between the parties should have been omitted from the preliminary investigation. There, the boy is said to have written, among other things: “What do you mean I raped you?” and received the answer “but no” from the plaintiff.

According to the verdict, the girl must have provided incorrect information about how she and the boy ended up at the scene of the alleged crime. Some other information must also have been contradictory and difficult to understand.

The police: “He raped her after all”

Furthermore, information that was detrimental to the boy was omitted. Due to the police’s position on the question of guilt and the handling of the case, the district court stated that the “due objectivity” could be called into question.

The day after the boy reported the girl for rape, around ten young people appeared outside his home and behaved threateningly. The boy’s parents called the police. According to the investigation, the policeman who appeared should have said: “You understand that she is upset, you know how old she is, he has raped her or had sex with her”.

The boy was thus acquitted of the rape charge and the teenagers who threatened the boy were convicted of assault, illegal coercion, assault in court proceedings and aiding and abetting these crimes.

The judgment was appealed to the Court of Appeal, which now upholds the Luleå district court’s judgment.
