Antitrust investigation launched for alleged anti competitive agreement in the tenders

(Finance) – TheCompetition and Market Guarantor Authority has started ainvestigation against seven companies active in the maintenance and repair of vehicles (Autofficina F.lli Pennesi – General partnership, MFM Srl, Autofficina Pontina Srl, Drive Line Service SpA, Italmeccanica Srl, Pagliani Service Srl, Gruppo Officine Meccaniche AR.MA . Ltd.). The method was born from a report sent by Ama SpA in which the possibility of emerges conducted anti-competitive among the participants in the three procedures announced between March and May 2023 for the assignment of the maintenance service on chassis cabs and mechanical assemblies of the Iveco, Renault and Mercedes brands.

In particular, the participation methods they highlighted a lack of competition in all three procedures and unsatisfactory outcomes for the contracting authority. The critical issues would also continue in the tender procedure announced by Ama in December 2023, following the revocation of the first three competitive procedures. The seven companies may therefore have violated article 2 of law no. 287/1990.

Yesterday the Authority officials carried out inspections in the offices of companies and other entities deemed to be in possession of useful elements for the investigation with the aid of the Special Antitrust Unit of the Financial Police.
