The withdrawn exemption concerns a plan that was voted down by the Biltse city council last year. But because the project developer has appealed against this decision of the city council to the Council of State, the withdrawal of the exemption is still relevant. An important argument for the Bilt city council to vote against the plan was the damage that the housing would cause to nature. But with an exemption from the province of Utrecht in hand, project developer Verwelius could have argued that this is not a good reason because the province does give permission. Now that the waiver has been withdrawn, that argument has been weakened.
