AGCOM tightens rules on video platforms to protect minors

(Finance) – The Communications Regulatory Authority (AGCOM) approved the regulation which defines the rules aimed at protect minors and consumers from harmful content disseminated on digital sharing platforms video (so-called VSP or also video sharing platform).

The regulation, which will enter effective January 8, 2024defines the procedures with which the Authority can limit the circulation of content intended for the Italian public, issuing a removal order to the host platforms, even if these are established in another Member State.

In particular, having ascertained the presence of videos which may harm the physical, mental or moral development of minors, which incite racial, sexual, religious or ethnic hatred, as well as which offend human dignity, or which do not adequately protect consumers, AGCOM informs the competent national authority of the Member State in which the platform is established or considers itself as such, which has seven days to intervene.

In cases where there is no action by the Member State or the action taken appears inadequate, AGCOM may issue theorder directly to the platformwe read in a note.

However, if one occurs emergency situation due to the risk of serious, imminent and irreparable damage to users’ rights due to the disseminated content, AGCOM, after communicating to the European institutions and the other competent member states, may immediately give the order to the platform, which must adjust in 3 days.
