A YouTuber makes fun of the DFB team, lawyer sees 3 possible criminal offenses in the action

YouTuber Marvin Wildhage is trying what all football fans want: to stand on the pitch with his idols once in his life. To do this, the journalist has to go to the limits of what is permitted and beyond. And this is not the first time. Could he now face legal consequences? A legal expert gives his opinion.

This is how the YouTuber makes fun of the entire DFB

Wildhage has come up with a sophisticated plan for his latest venture. He wanted to mingle with the stars as a disguised player at the DFB selection’s public training in Jena. His plan consists of three steps:

  • Step: Wildhage disguises a black van as a VW bus as the official DFB car. To do this, he sticks a VW logo on his black bus. Next to it, he places the DFB logo in the same size.
  • Step: In order to get past the security and stewards in the stadium, he has to identify himself as a DFB employee. To do this, he uses Photoshop to create a work ID card based on an image template and uses it to pretend to be an employee of the social media team.
  • Step: In order not to stand out among the players, Wildhage orders the authentic DFB warm-up outfit and also has the VW logo flocked. He already wears the training clothes under his normal outfit.
  • Is he committing a crime with the prank? Expert gets involved

    Who is the expert? Christian Solmecke is a lawyer and partner at the WBS Legal law firm in Cologne. The lawyer has been active online for 13 years now and runs the WBS Legal YouTube channel. On this channel he comments on various legal cases every week.

    The lawyer became really well-known around 6 years ago when he commented on the bans on various professional groups such as teachers, police officers, etc. Solmecke now uses his expertise and fame to classify public issues from a legal perspective.     What crimes does the YouTuber risk? According to experts, the YouTuber could be charged with the following crimes:

  • Infringement of trademark law regarding the use of the VW logo
  • Trespassing by entering the restricted areas of the stadium
  • Forgery of documents by copying the DFB employee ID card
  • What’s particularly piquant is that Wildhage was previously sentenced to a fine of over €3,000 for forgery. In 2020, he had made a fake ID card with a false doctorate title. Solmecke also worked on this case legally on YouTube.

    This is how Solmecke classifies the YouTuber’s potential criminal offenses:

    At the beginning of his reaction, Solmecke states that many of the actions before and during the prank are at least in the legal grey area. He then classifies the individual possible criminal offenses:

    To 1: There is no direct violation of trademark law, as Wildhage did not earn any money with the VW logo.

    2: It is also rather unlikely that the DFB will report the YouTuber for trespassing. After the interlude, Wildhage was not expelled from the stadium, but merely relegated to the stands as a punishment.

    To 3: The expert sees the YouTuber’s copied employee ID card as the most controversial, as it could result in the most severe punishment under the offense of forgery. Up to five years’ imprisonment is considered for serious offenses.

    What could benefit the YouTuber: Copies of documents fall into a legal grey area, as they are not actually legally binding documents. In addition, Solmecke cannot imagine that a complaint would be filed, as the action would not have had any negative consequences for those involved.

    It seems that the YouTuber will not face any consequences this time. The reactions of a DFB star one day after the prank also suggest that the action was received with humor.

    After a short stint on the bench, he was finally accompanied to the stands by a DFB employee. Wildhage himself considered his project a complete success. For a while, he was able to be very close to the football stars.
