When driving a car, you must keep your eyes open and pay attention in order to drive your vehicle safely.

On February 1, 2018, the Swedish traffic regulation was therefore amended, whereupon it became prohibited to hold a mobile phone in the hand when driving a motor vehicle.

However, there are still ways to legally use your cell phone while driving.

The mobile phone while driving can lead to a fine

The rules mean that you can be sentenced to a fine if you are caught driving a motor vehicle while holding a mobile phone in your hand.

It is also not permitted to hold other communication equipment, such as a GPS, in your hand while driving.

However, the ban does not mean that it is completely forbidden to use the mobile phone while driving, but it is still permitted to, for example, make calls, listen to music or use the mobile phone’s navigation while driving.

The critical thing is that you must not hold the mobile phone in your hand. With the help of technical aids such as voice control or hands-free, it can therefore be perfectly legal to use the mobile phone while driving.

However, the rules do not mean that it is free to use the phone without restraint when driving, just because it is, for example, in a holder on the dashboard. Namely, it is only legal to use the mobile phone if “it does not adversely affect the driving of the vehicle”.

Relatively soon after the ban on holding communication equipment while driving was introduced, it was realized that a number of exceptions to the rule were needed.

Since March 12, 2018, the ban does not apply when vehicles are used in the following scenarios, according to The Swedish Transport Agency website:

  • For emergency services and medical transport

  • When performing police duties

  • By certain personnel at the Security Police

  • By road transport managers according to the Act (2004:1167) on road transport managers

  • In the urgent performance of duty by a customs officer, coast guard officer, doctor, nurse, midwife and staff within the Correctional Service or in other comparable cases.
