The Jönköping municipality was wrong to require a police permit for the rental of e-scooters, the court of appeals believes.

But the municipality is still satisfied.

– We have achieved what we wanted, says general counsel Lars-Åke Svensson.

It was in the fall of 2022 that the municipality in a local ordinance introduced a requirement for a police permit in order to rent out so-called one-person vehicles.

However, the County Administrative Board overturned the decision with reference to the Public Order Act and has now been right in the Court of Appeal as well.

“The municipality of Jönköping cannot, in its own local ordinances, set requirements for something that is already regulated in the ordinances,” writes the court of appeals in a press release.

However, the municipality’s chief legal officer Lars-Åke Svensson sees the verdict as a victory.

– Then we are satisfied. We wanted to have it tested if this is covered by the Public Order Act, because the police in different parts of Sweden had different views on it, he says.

– So if the ordinance applies, there are no problems, on the contrary, it’s great.
