The man was first sentenced in the Nyköping district court to five years in prison for raping the intellectually disabled woman.
But the Court of Appeal held that nothing else has been proven other than that the woman participated voluntarily in the sexual acts. According to the court, she had shown the ability to both make demands on the man and to calm down during their relationship.
Now the Attorney General wants HD to take up the case. This is to get clarity on how the law is to be interpreted with regard to dependents and particularly vulnerable situations.
