Donald Trump has previously said that his actions to change the 2020 election results were official duties and that he should not be prosecuted for them.
In the United States, a federal judge has released a court document in which prosecutors have listed new evidence of how the former president Donald Trump tried to overturn the 2020 presidential election results.
The US Supreme Court ruled in July that the president has immunity from prosecution for his official duties during his presidency.
Special Prosecutor Jack Smith’s according to Trump does not enjoy presidential immunity because his efforts to stay in power after losing the 2020 election were not related to his position as president or his duties as president. Instead, Smith believes that Trump was acting as a political candidate at the time of his actions, seeking to be re-elected.
Trump has previously argued that his actions to change the election result were official duties and that he should not be prosecuted for them.
Prosecutors: Trump decided to declare himself the election winner regardless of the result
The 165-page court documents released Wednesday list new testimony about Trump’s activities around the 2020 election.
According to the prosecutors, the White House employee had, among other things, testified that he had heard how Trump told his family members that it didn’t matter if he won or lost the election, because “anyway you have to fight like hell.”
Trump’s lawyer is said to have informed Trump that the election fraud accusations presented by him would not be successful in court. “The details don’t matter,” prosecutors say Trump made comments to the lawyer.
According to prosecutors, Trump also told his aides that he would “simply declare himself the winner of the election before the votes were counted” regardless of the outcome of the election.
As the violent takeover of the Capitol was underway on November 6, 2021, an aide rushed to Trump and announced the vice president Mike Pence being potentially at risk. “So what?” claim the prosecutors against Trump.
Along with the prosecutors, among others, the examples mentioned above prove that Trump’s attempts to overturn the election result had nothing to do with the president’s official duties.
The matter will not go to court before the November 5 presidential election. If Trump wins the election, it is considered very likely that he will order the Justice Department to drop the charges.
