(Finance) – “La urban regeneration it is a virtuous process that is important to be pursued also through new national legislation. To bear fruit, however, it must follow, in line with the latest generation regional legislation, two guidelines: that of incentivesboth in terms of development rights and fiscal measures, and that of involvement of property owners.
From this point of view, we believe – and we said this in the parliamentary hearing – that the unified text of the bills presented on the matter in the Senate needs to be modified in at least two points.
On the one hand, in our opinion it is necessary remove the rules (contained in paragraphs 1 and 2 of article 12) which provide that the approval of urban regeneration plans and programs involves the declaration of public utility of the planned interventions and the consequent expropriation power vested in the Public Administration. It is, in fact, an approach that does not take into account the experiences gained over many years, in which the system of planning agreements between the Municipality and private individuals has proven to be a tool capable of encouraging the necessary involvement of property owners and, thus, to facilitate the implementation of interventions, avoiding disputes. The tool for planning and implementing urban regeneration must, therefore, be that of urban planning by agreement and, to this end, the provision of a discipline, at the level of state legislation, of equalization institutions is also of fundamental importance, compensation and construction bonuses.
From the same perspective, we consider it inappropriate to grant municipalities the power (contained in article 11, paragraph 8) to progressively raise the IMU rates provided for on real estate units or buildings that have been unused or unfinished for more than five years. In fact, fiscal leverage must be used to incentivize, not to punish.
We are confident that through a constructive dialogue it will be possible to intervene on the text for the attention of the Senate Environment Commission so that it is capable of achieving the ambitious objectives it proposes”.
