The generous payout for eleven days of sick leave was SEK 234,000 too much, reports P4 Seven-way.
The insurance company apologizes for the mistake but now demands the money back from the woman – who does not really agree.
Not all the money is left, and according to P4 Sjuhärad, the woman says that it is unreasonable that she should have to take out a loan to pay the Social Insurance Agency and that she should not be punished for the authority’s mistakes.
Then she may be entitled to the money
The legal principle states that whoever has paid out incorrectly or, as in this case, too much, should get the amount back. But there are exceptions, if in this case the woman was in good faith regarding the payment and that she established herself after the payment.
If the woman was in good faith, she neither realized nor had the prerequisite to realize that the payment was too large. It can also be decisive how long it took between the payment and Försäkringskassan’s demand for repayment. If the woman has established herself after the payment, she has adjusted her finances after the payment or spent the wrongly paid amount.
The woman has now been offered a twelve-month installment plan, the radio writes.
