Renee McLellan was spotted in June 2021 in a parking lot of Metcalfe Street in Simcoe as police officers were investigating reports of drug trafficking.

“They saw Renee McLellan with two others know to be involved in the drug subculture,” Crown prosecutor Jamie Pereira told Justice Gethin Edward.

“They saw her extend her arm and provide a small item to (a man) and saw him give Renee McLellan cash.”

Police arrested both parties and found 15 grams of fentanyl in McLellan’s purse, along with about $175 in cash.

The investigation found she had sold .03 grams of fentanyl to the buyer. The drug can kill in extremely small doses but users can tolerate more and more fentanyl as they continue to take it.

McLellan was also charged with failing to return to court in January this year, when a warrant was issued for her arrest.

Pereira said he wanted a sentence of two years and seven months on top of her time served of 99 days, which is credited at 150 days.

McLellan’s defense lawyer, James Battin, said justice would be served with a two year prison sentence and putting her time served toward her fail to appear charged.

The judge agreed that, despite the lack of a record, McLellan should go to the penitentiary for two years to indicate the seriousness of her crime.

“What’s at play here is the necessary rehabilitative treatment,” said Edward, adding McLellan’s addiction issues could be helped at the women’s penitentiary in Kitchener.
