Sarnia man facing robbery rap picks up new charges

A young Sarnia man charged after an alleged armed robbery attempt at a local casino was arrested Thursday night on new charges tied to breaking and entering and a stolen motorcycle, police say.

Officers were sent to Kathleen Avenue near Indian Road North about 7 pm after a homeowner reported a suspect in their backyard had broken into their house, police said. Officers found a suspect pushing a blue motorcycle through a nearby parking lot and tried to arrest them, but they resisted.

The suspect was subdued after more officers arrived, police said. There were no injuries.

“Investigation revealed the motorcycle was stolen earlier that day from a College Avenue residence,” police said.

Kristian Spitzig-Carver, 21, of Sarnia, is charged with breaking and entering, possessing stolen property, resisting arrest and breaching lease, police said. He was held after a brief lease hearing Friday. He returns to court Monday on video from the Sarnia Jail.

Spitzig-Carver and two other Sarnia residents, Cyrus Wade, 20, and Lillian Delben, 21, were charged after a series of incidents starting April 24 at Jackpot City Gaming casino, Sarnia police said at the time.

Two males showed a handgun and demanded the winnings of a man playing a gaming machine. He refused and they left.

The next day, suspects took shopping carts worth of merchandise and filled a car with gas — from businesses on Williams and Quinn drives, Wellington Street, and Lakeshore Road in Bright’s Grove — without paying, police said. Neighboring police services were alerted to the suspects and a vehicle involved, police said.

Provincial police found the vehicle at a Confederation Line residence near Mandaumin Road and arrested three people, police said. A pellet gun resembling a firearm was found in the vehicle, they added.

Wade was charged with robbery, two counts each of theft under $5,000 and breaching probation, and single counts of possessing a weapon for a dangerous purpose, carrying a concealed firearm, using a firearm while trying to commit an offense, pointing a firearm, and possessing a firearm without authorization, police said.

Spitzig-Carver was charged with robbery and theft under $5,000. Delben was charged with theft and breaching bail. She also had 14 prior counts of theft under $5,000 before the courts, police said.

Wade and Spitzig-Carver both eventually got bail, but Delben has been in jail since then.

On Friday, within minutes of Spitzig-Carver’s court appearance, Delben was in another Sarnia courtroom pleading guilty to a slew of charges linked to the late April incident and other unrelated thefts. No facts were heard and her sentencing was adjourned to October to obtain a pre-sentence report.

Wade pleaded guilty in mid-June to several of the charges, including carrying an imitation handgun for a dangerous purpose, carrying a concealed imitation firearm, attempted robbery, theft under $5,000, and two counts of breaching probation. The court only heard brief facts linked to the theft and probation breach, with the main agreed statement of facts being adjourned to September, when a pre-sentence report is ready.

No charges in either case against Spitzig-Carver have been tested in court.
