A suspicious uncle captured video of his underage niece having sex with her former stepdad last year, resulting in the man being sentenced to the penitentiary when he appeared recently in Simcoe court.

The 59-year-old father of three, who cannot be named as it would identify his victim, was quick to admit his crime to police when he was arrested.
In court, he pleaded guilty to sexual interference.
In July 2023, the man visited his former step-daughter at a residence in Simcoe and the two went into a bedroom on the premise of playing video games together.
But the girl’s uncle was also in the residence and found it odd when he didn’t hear any gaming sounds.
“He said there was silence and he thought that was bizarre,” said assistant Crown attorney Lynette Fritzley during the man’s sentencing hearing.
“He captured video through a crack in the wall and saw two parts, under the cover of blankets, moving in a rhythmic fashion.”

The girl confirmed she had sex with the man, telling police she felt “in her gut” that something was wrong but thought she was able to consent to the act.
The teen did not participate in the sentencing or submit a victim-impact statement.
The Crown and defense lawyers presented a joint submission to Justice Gethin Edward for the man to go to prison for four years, which the judge said was on the “low end of the scale”.
“Four years is lenient, but it’s offset by the fact that the guilty plea keeps the vulnerable victim from having to testify,” said Edward, noting the Supreme Court of Canada has made it clear those who victimize children will get penitentiary sentences.
Along with his prison sentence, the man was placed on the sexual offenders database for 10 years, had to provide a DNA sample to police and was ordered not to live within two kilometers of his victim and her family once he’s released.
