Boards of Statutory Auditors, de Nuccio: “Chamber approval, historic milestone”

Boards of Statutory Auditors de Nuccio Chamber approval historic milestone

(Finance) – “A historic achievement. A success for the accountants Italians, but also for businesses of our country and for the economic system as a whole”. This is what was stated by the president of the National Council of Accountants, Elbano de Nuccioduring the press conference held today at House of Representatives after the approval with the unanimous vote of majority and opposition of the bill 1276 to amend the art. 2407 of the Civil Code which limits the civil liability of the members of the supervisory body of board of auditors.

The legislative initiative – which is strongly supported by the National Council of Accountants, sees how the first signatory was the Honorable Marta Schifone and is signed by the group leader of the members of the Fratelli d’Italia Thomas Foti and by the members of the Montecitorio Finance Commission registered in the Registers of Accountants Andrea de Bertoldi, Mariangela Matera, Erio Congedo, Guerino Testa and Carolina Varchi – now heads towards the Hall of Palazzo Madama.

The provision establishes in a single article that, except in cases of fraudmayors who violate their duties are liable for damages “within the limits of a multiple of the annual compensation received”in increments: up to 10,000 euros fifteen times the emolument, from 10,000 to 50,000 euros twelve, over 50,000 euros ten times the sum obtained in payment.

“There perimeter of civil liability of the members of the supervisory body – stated de Nuccio – is an objective for which this National Council fought since its establishment and which is now coming to fruition thanks to the intense dialogue carried out with the institutions. I express a very strong opinion appreciation, on behalf of the entire community of Italian accountants, for today’s achievement. It is a historical passage for which I thank all the political forces, both majority and opposition, the Honorable Marta Schifone, who led this battle personally, the undersecretary Alfredo Mantovano, who has always demonstrated his support for the parliamentary initiative, and the President of I recommend Giorgia Meloni who, also on this dossier, has repeatedly publicly expressed closeness and agreement with our proposals”.

“The perimeter, and not the limitation, of the responsibility of professionals – continued de Nuccio – it is a substantial and not formal act of justicewith which yes finally guarantees greater quality of the organ control. As it was written, the law has driven away the best professionals over the years, depressing the quality of the control body, due to the real fear of being involved in compensation actions with important not only economic but also reputational weight. The bill approved today by the Chamber of Deputies, for which we are confident of rapid approval also in the Senate – he concluded – guarantees a leap in quality in the controls of our companies, especially medium and small ones, with clear positive effects for the entire economic system”.
