Luleå resident acquitted of child rape – the Court of Appeal overturns the verdict

It was last autumn that the man from Luleå was sentenced. The district court’s assessment relied almost entirely on the girl’s information and found her testimony to be clear and credible.

They also thought that the man’s statement was strikingly vague.

“XX has had sex with the plaintiff despite her several times saying no,” the district court wrote in its verdict.

Tear up the prison sentence

The Court of Appeal also believes that the girl’s story is credible – but that words stand against words. They therefore free the man who has denied the deed all along.

“The Court of Appeal has also assessed that the investigation contains certain shortcomings. The overall assessment is that the supporting evidence and the investigation in the case do not achieve such strength that it corresponds to the high standard of proof that applies in criminal cases,” they write in the judgment.

The Luleå residents also do not have to pay damages to the girl.
