Municipality required for compensation after child abuse

The Discrimination Ombudsman (DO) requests that a municipality in Västmanland pay discrimination compensation of SEK 300,000 to a child who was raped by an employee at a preschool in the municipality.

The pre-school teacher is convicted of the rape, but the crime also constitutes sexual harassment according to the discrimination act, according to DO. As the responsible education provider for the preschool, the municipality must therefore pay discrimination compensation to the child, the authority writes in a press release.

“The preschool teacher bears criminal and tort liability for the act, but the municipality also bears compensation responsibility as the educational provider for the preschool where the violation took place. In order to prevent incidents of this serious nature, it is justified that the discrimination compensation is known to the municipality,” says Sofie Rykowski, lawyer at DO’s process unit, in a comment.

The municipality has until August 24 to take a position on DO’s demands.
