What should be done when faced with a bullet wound?
According to articles of the Public Health Code and the Code of Medical Ethics, doctors are bound by professional secrecy. “This is what creates trust between a doctor and his patient.“recalls Dr Gérald Kierzek, emergency doctor and medical director of Doctissimo.
“Only a few derogations exist, in particular when faced with a minor patient in danger, for example. In these situations, medical secrecy cannot be opposed and the authorities must be notified. In this case, in this case, it was not up to the management of the hospital to warn the police, and if so, it seems to exceed the legal framework” says the doctor.
On the website of the Departmental Council of Saone et Loire of the Order of Physicians, we can read:
“In the absence of such an exemption, they do not have to reveal to the police services, nor to the director of an establishment, the admission or the care given to a wounded by firearm or bladed weapon, that the patient either victim or perpetrator. It is up to the victim, if she wishes, to lodge a complaint.
However, if the injured person is a minor, the doctor must make a report to the Public Prosecutor under the conditions provided for in article 226-14, 2° of the Penal Code. The doctor will keep the extracted projectile in his possession and return it to the police in the event of an investigation”.
