Punishment was wrongly increased canceled by HD

A man convicted of fraud had his sentence increased by six months by the district court after the sentence gained legal force, writes Dagens Juridik. It happened through a so-called correction. Now the Supreme Court has decided to lift the increase in punishment.

According to the original verdict, the man was sentenced to two years in prison, in a larger fraud case involving several defendants.

After the Court of Appeal upheld the District Court’s decision to change the sentence, the man went on to the High Court – which announced leave to appeal at the end of last year.

HD takes note that the district court’s decision came without the man having the opportunity to express himself and cancels the correction.

The court writes, according to Dagens Juridik, that the defendant must be able to rely on “the basic principle that the ruling must be unshakable and can only be challenged with special legal means” after the judgment has gained legal force.
