Nintendo Celebrates Blow Against Pirates – Makes as much money as if they had sold Mario Kart 8 7,385 times

Once again, Nintendo pays dividends for being so vigilant about taking action against anyone and anything that violates their rights. For example, Nintendo has sued a site for damages that offers pirated copies of Nintendo games and failed to respond to requests to block that content. Nintendo struck and was awarded more than €400,000 in damages. Nintendo says this is a big win for themselves and for the entire video game industry. The sides could now no longer refer to previous cases and remain inactive.

Who did they sue?

  • Nintendo has sued the operators of the “Dstorage” site.
  • In a statement, they say: The Court of Appeal has ruled that the site is responsible for allowing pirated Nintendo games to be distributed through file hosters such as 1fichier.com.
  • As a punishment, Nintendo has now been ordered to pay $442,750 – and the site will also have to pay €25,000 in court costs. For €442,750 you get around 7,385 copies of Super Mario Kart 8 Deluxe, which is the best-selling game on the Nintendo Switch.

    This is how the process went: Nintendo had asked the site to remove the unauthorized games from its site. When that didn’t happen, Nintendo went to court and won in Paris in May 2021.

    Now in April 2023 the verdict of the lower instance before an appellate court was valid (via gamesindustry.biz).

    That’s what Nintendo says: Nintendo says they are happy with the decision. The judgment sends a clear signal: Such websites would have to withdraw and block access to pirate copies of video games by file hosters.

    If they refuse despite being informed of the violations, it should now be made clear that such sites can also be held liable if they violate copyrights.

    This is not just a victory for Nintendo, but for the entire gaming industry. Now sharehosters like 1fichier could no longer refer to previous decisions that a court is needed before pirated copies are taken down.
